Terms of service

Agreement

These terms govern your use of NextWho and nextwho.space (the "Service"), operated by NextWho ("we", "us"). By creating an account or using the Service, you agree to these terms. If you are signing up on behalf of a company, you represent that you have the authority to bind that company.

Acceptable use

You agree not to use the Service to:

  • Surveil, monitor, or rate individual employees beyond the structural workflow changes they make.
  • Upload content you do not have the right to share, including personal data of people who have not consented.
  • Interfere with the Service: probe for vulnerabilities outside our disclosure program, abuse rate limits, or attempt to access data outside your workspace.
  • Resell or sublicense the Service without a written agreement.

We may suspend accounts that violate these rules, with notice where reasonable.

Account responsibility

You are responsible for activity under your account, including the actions of members you invite to your workspace. Keep credentials secret, use strong passwords, and tell us immediately if you suspect an account has been compromised. Owners are responsible for managing roles and removing former teammates.

Subscription terms

NextWho is offered on monthly and annual plans. Pricing for self-serve plans is shown on the pricing page.

  • Monthly or annual billing; Net-0 upon invoice; payments processed by Stripe.
  • 15% reduction for annual upfront billing.
  • 14-day limited access trial; credit card required for activation.
  • Annual plans: pro-rated refunds only within the first 30 days of a billing cycle. Monthly plans: no refund after 7 days of use.
  • 99.9% monthly uptime. Operations: initial response within 4 business hours; starter and team: initial response within 24 hours.
  • DPA available on request for GDPR/CCPA compliance.

Data ownership

You own the workspace content your team creates. We hold the rights you grant us in these terms to operate the Service: hosting, processing, displaying, and backing up your content. We do not claim any ownership of workflows, SOPs, or other documents you enter into the Service.

Limitations of liability

The Service is provided "as is" without warranties beyond those required by law. NextWho is not liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue, whether arising under contract, tort, or any other theory of liability.

To the fullest extent permitted by law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the event that led to the claim.

Termination

We may suspend or terminate accounts that materially violate these terms, fail to pay, or pose a security risk. We will give reasonable notice and an opportunity to cure where appropriate.

On termination, your right to use the Service ends. You will retain access for a reasonable export window unless we are required to terminate immediately.

Changes to these terms

We may update these terms to reflect product changes or legal requirements. Material changes will be announced in-app and by email at least 30 days before they take effect for paying customers. Continued use after the effective date constitutes acceptance of the updated terms.

Governing law

These terms are an agreement with NextWho Systems LLC, registered office 1201 North Market Street, Suite 1400, Wilmington, DE 19901, United States, and are governed by the laws of the State of Delaware, United States.
